These Terms & Conditions ("Terms") govern your access to and use of the websites, apps and services of Esimify Global Private Limited ("eSIMify", "we", "us", or "our"). By creating an account, purchasing a plan or otherwise using our services, you agree to these Terms.

1. Our service

eSIMify sells digital eSIM data plans that let you connect to mobile networks in 190+ destinations. eSIMs are delivered electronically (QR code and/or in-app activation) after successful payment.

2. Eligibility & account

You must be capable of entering into a binding contract to use eSIMify. You are responsible for keeping your account details accurate and secure and for all activity under your account. Providing a valid name and contact number is required so that payments are processed correctly and are not flagged by our payment partners.

3. Orders, pricing & payment

Prices are shown at checkout in your selected currency and include applicable charges. Payment is processed through secure third-party payment gateways acting solely to complete your transaction. Your order is confirmed once payment is successful and the eSIM is issued.

4. Delivery & activation

eSIMs are provisioned digitally. It is your responsibility to ensure your device is eSIM-compatible and carrier-unlocked before purchase. Activation windows, validity and data allowances are shown on each plan.

5. Fair use & acceptable use

Plans are for personal use. You agree not to use the service for anything unlawful, fraudulent, abusive, or in breach of the underlying networks' fair-use rules. We may suspend service for misuse.

6. Networks & coverage

Connectivity is provided over partner mobile networks. Coverage and speeds depend on the local network and your device, and can vary by location. If you face network issues, please contact support (see our Refund Policy for how usage-based refunds work).

7. Refunds & cancellations

Refunds and cancellations are governed by our Refund Policy and Cancellation Policy, which form part of these Terms.

8. Privacy

We handle your data in line with our Privacy Policy. We do not sell or share your personal information with third parties for their own use.

9. Intellectual property

All content, trademarks and software on eSIMify are owned by or licensed to Esimify Global Private Limited and may not be copied or used without permission.

10. Limitation of liability

To the maximum extent permitted by law, eSIMify is not liable for indirect or consequential losses, or for interruptions caused by device incompatibility, local network conditions, or factors beyond our reasonable control. Our total liability for any claim is limited to the amount you paid for the relevant plan.

11. Changes

We may update these Terms from time to time. Continued use of the service after changes are posted means you accept the updated Terms.

12. Governing law & jurisdiction

These Terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts at Navi Mumbai, Maharashtra, India.
